Lawyer, Jeff Boston, from the law offices of Arcadier and Associates, P.A. is a veteran attorney with over 60 criminal law jury trials, helped procure a Not Guilty verdict in the 2-day felony trial of his client Steven Diaz in Osceola County on August 3rd and 4th. Mr. Diaz was charged with Aggravated Assault with a Deadly Weapon, a 3rd-degree felony punishable by a maximum of 5 years in prison. In this case, the “deadly weapon” was a car. Mr. Diaz had no intent to use his car as a deadly weapon. Mr. Diaz was simply driving away of the alleged victim who was actually the aggressor.
The prosecutor’s office had 4 witnesses, while the defense had one – Mr. Diaz, age 28 and a father of 3 with 2 jobs and no adult criminal record.
After delivering a passionate, thorough closing argument and hearing the recitation of the verdict, Mr. Boston told his client “justice was served.”
This is an example of another loss by the prosecutor’s office. The facts of this particular case make it clear that the prosecutor’s office should not have filed this case against Mr. Diaz and should have heeded Mr. Boston’s requests for all charges to be dropped.
