State and Federal Whistleblower laws prevent an employer from taking retaliatory action against an employee who has engaged in protected activity. Protected activity means the disclosure of activity which is illegal or that it violates a law, rule or regulation. The activity must be reported to the appropriate government agency. Under Florida Law, the private whistleblower act is codified under Florida Statute 448.102. The law provides a prevailing plaintiff with damages which may include attorney fees, costs, back pay, and reinstatement or other injunctive relief as applicable based on the facts.
