Personally nominating your child’s guardian may prevent family fights and court battles over who will be the guardian. You can nominate a guardian for your child and your child’s property in your will. The guardians of the child and the property do not have to be the same person. In fact, depending on the guardians’ strengths and weaknesses, it may be best to divide the responsibilities. Who takes care of your child and your child’s property is one of the most difficult and important decisions you will have to make. Don’t you want to have a say in that decision? If you are a parent, you should create an estate plan to ensure that your children will have the resources they need if something should happen to you.
